By participating in the 5-hour ENERGY^® The Outer Worlds 2 Gift with Purchase Promotion (the “Offer”), you understand and agree: (a) to abide by these Terms and Conditions; (b) to release Living Essentials, LLC (the “Sponsor”), US Sweepstakes & Fulfillment Co. (the “Administrator”), and their respective affiliated companies, and all other businesses involved in the Offer, as well as the employees, officers, directors, and agents of each (the “Released Parties”), from all claims and liability relating to your participation in the Offer and the acceptance and use/misuse of the item offered; and (c) that all decisions by Sponsor and Administrator regarding this Offer are final and binding in all respects. Failure to comply with these Terms and Conditions may result in disqualification from the Offer. Offer is subject to all applicable federal, state and local laws and regulations. Sponsor reserves the right to substitute or limit Offer. Sponsor reserves the right to modify these Terms and Conditions set forth herein at any time, including, but not limited to, the duration of the Offer Period.

OFFER PERIOD: Offer begins at 12:00:01 AM Eastern Time (“ET”) on Friday, September 12, 2025 and ends at 11:59:59 PM ET on Saturday, February 28, 2026 or while supplies last (“Offer Period”). Quantities are limited. Purchases must be made during the Offer Period and claims must be submitted before Offer Period ends. Should the supply of Offer Items be exhausted prior to February 28, 2026, Sponsor will not have any liability under any legal theory in conjunction therewith.

ELIGIBILITY: The Offer is only open to legal residents of the 50 United States, including the District of Columbia, who are age 18 or older at the time of purchase. Offer is void outside the U.S., and wherever else prohibited by law. Employees of the Released Parties and their respective subsidiaries, affiliates, advertising and promotion agencies, are not eligible to participate.

OFFER ITEM: Eligible participants who submit a qualifying Offer Claim (as described below) will receive one (1) digital code that can be redeemed on Xbox, Steam, or PlayStation for one (1) in-game Raptidon pet skin for use with The Outer Worlds 2 (the “Offer Item”). Skins require The Outer Worlds 2 game (sold separately). Rated M for Mature. The Offer Item is digital-only and will be delivered via email to the email address provided at the time of claim. Allow up to six (6) weeks for delivery. Digital Codes must be redeemed by May 31, 2026. Make sure to redeem your digital code(s) on the same platform on which you play The Outer Worlds 2 game. Offer Items will not be replaced if lost or stolen. Offer Items are subject to the issuing company’s terms of use, including expiration dates. The Offer Item has no cash value and is non-transferable. No substitutions will be made, except at Sponsor’s discretion. Actual Offer Item awarded may vary from that depicted in advertising materials. Any Offer Item depiction is for illustrative purposes only.

HOW TO CLAIM AN OFFER ITEM: There are two (2) ways to claim an Offer Item (each, an “Offer Claim”). All Offer Claims must be submitted via one of the claim methods below. All Offer Claims must be submitted during the Offer Period.

1. Offer Claim Method #1 / Retail Purchase:
   • Purchase any single 5-hour ENERGY^® product (bottle) or any multi-pack 5-hour ENERGY^® product (bottle) from a participating retailer during the Offer Period.
   • Collect your original, itemized, store-identified purchase receipt dated during the Offer Period (“Receipt”). Keep your Receipt. Sponsor reserves the right to require a participant to provide original receipt for verification purposes upon request.
   • Take a photo of the Receipt (“Receipt Photo”). Receipt Photo must clearly show store where purchased, purchase date and qualifying product purchased. Photo must be in .jpg or .png format. Photos of online purchase receipts and cash register receipts are acceptable.
   • Visit 5HEGAME.COM and follow the instructions to complete the online claim form and submit your Receipt Photo.

   Each receipt submitted must be unique. Regardless of the number of Qualifying Products indicated on the receipt, there is a limit of one (1) Offer Item per unique, qualifying receipt. Attempts to gain additional Offer Items by submitting a receipt that has already been submitted will be disqualified. Receipt reprints are not eligible and will not be accepted. Only valid Receipts and Receipt Photos will be accepted for this method of participation and are subject to verification and will not be returned.

2. Offer Claim Method #2: 5hourenergy.com Purchase:
   • Purchase any 6-pack, 12-pack or 24-pack of 5-hour ENERGY^® Purpleberry Punch or Mock Melon Brew from 5hourenergy.com.
   • Upon completing the purchase transaction, follow the instructions to click on a web banner or link to opt into the Offer and visit the online offer page (“Offer Claim Page”).
   • Upon visiting the online Offer Claim Page, follow the instructions to complete and submit the online claim form.

Limit: Regardless of the method from which an Offer Claim is submitted, you may only submit one (1) Offer Claim and there is a limit of one (1) Offer Item per person/account, while supplies last. Although subsequent attempts to submit an Offer Claim for this Offer may be received, only the first complete submission received from a particular participant will be considered for this Offer; subsequent attempts by the same person to submit an Offer Claim for this Offer, including submissions submitted with an alternate email address, will be disqualified.

Purchases that are cancelled, declined, returned or otherwise not completed will not result in a qualified Offer Claim. All Offer Claims are subject to verification. Sponsor reserves the right to disqualify any suspicious offer claims (in Sponsor’s sole discretion) and any participant who submits false, misleading, or fraudulent information, or who tampers with the Offer in any way. All submissions become the property of the Sponsor and will not be acknowledged or returned. Photocopied, illegible, or mechanically reproduced submissions are not eligible.

Participants are responsible for providing their valid email address at the time of submitting an Offer Claim. The Offer Item will be delivered to the email address such participant provides. Changes to email address after submitting an Offer Claim and incomplete email addresses will not be accepted and may result in disqualification. Sponsor shall have no liability for any email containing the Offer Item that is lost, intercepted or not received by the participant for any reason.

PRIVACY: Personal information collected from participants are subject to the Sponsor’s Privacy Policy, which can be found at https://5hourenergy.com/pages/privacy-policy.

GENERAL CONDITIONS: The Sponsor reserves the right to modify, extend, suspend, or terminate the Offer if it determines, in its sole discretion, that the Offer is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor's control (i.e. a force majeure event, such as pandemic/epidemic, strike, civil unrest, natural cataclysm) have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Offer as contemplated herein. The Sponsor reserves the right to discontinue the participation privileges of any participant who engages in any fraudulent activity or uses the Offer in a manner inconsistent with these Terms and Conditions or with any federal, state or local, laws, statutes or ordinances. In addition, Sponsor shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion. This Offer may not be published, posted or otherwise displayed and/or offered for sale in any electronic or other venue without Sponsor’s express written permission. Only individuals may redeem this offer; requests submitted by clubs or organizations will not be honored or returned.

Released Parties are not responsible for lost, late, or incomplete claims. Ineligible, incomplete, or illegible claims and/or receipts will not be accepted. Participants assume all liability for and Released Parties shall be held harmless against any liability for any injury, losses or damages of any kind to persons, including personal injury or death, or injury to property caused or claimed to be caused in whole or in part, directly or indirectly, by participation in this Offer, acceptance, possession, or use/misuse of the Offer Item, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Sponsor is not responsible for any typographical or other error in the printing or administration of the Offer. Participation materials/data that have been tampered with or altered, or mass claims or claims generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible claims; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of claim materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions, failures or errors of any kind, including the failure of intended recipient to receive Offer Item email from the Sponsor, or inaccurate transmission of or failure to receive claim information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to participant’s or any other person's computer related to or resulting from participating in the Offer.
